By using this Site, you accept the practices that are described in this Privacy Statement (the “Statement”), which is effective as of 2/1/2005 and is part of the Terms of Use governing use of this Site. What personal information do we collect about our customers?

We collect the personal information that our customers give us when they choose to purchase a product or service, request a quote, or use our Site in other ways. For example, if you register with Demag to make a purchase, we will ask you to provide your name, company name, billing address, telephone number, e-mail address, and credit card information. We will also ask you for a shipping name and address if they differ from the billing name and address. Similarly, we will ask you for contact information such as your telephone number and e-mail address if you request a price quotation on a product or service or submit an e-mail question or comment to us.

What other kinds of customer information do we collect?

If you ask us to ship a purchase to a different location, we will ask you for the name, address, and contact information for the company to which you are sending the product or service, as well as your name and billing and contact information. The information identified with the company to which you are sending a product or service is not used for any additional purpose.

Our system also keeps track of the URL source of orders to determine commissions and collects aggregate information about traffic patterns and usage of the Site.

How do we collect this information?

When you register with the Site, we compile the personal information you give us about yourself into an individual profile. We add other personal information about you to that profile as you give it to us. We also collect information about your purchases and other uses of our Site as they are made. When you request a price quotation, submit an e-mail question or comment, or seek other information from us, we collect your contact information so we can respond. Quotations are stored for a limited time for customers’ reference and use.

How do we protect customers’ personal information?

All of your personal information is stored on a secure server protected by firewalls which is maintained in a facility with restricted access. Access to customers’ individual profiles is password protected. Purchase information, including credit card information, is encrypted by Secure Sockets Layer (SSL) software when it is transmitted to us. We also truncate the relevant credit card number to the last four digits when we communicate with a customer regarding an order. Credit card information is maintained only until a transaction has been authorized and is then deleted.

How do we use information about our customers?

We use your personal information to process your orders and requests. This includes, for example, contacting you to confirm your order, fulfilling the order, and shipping it. We may also contact you if we want to communicate with you about your order or request or to notify you of its status.

Additionally, we analyze information concerning our customers’ purchasing activities through our Site to determine the amount owed our partners, dealers, and distributors as commissions on their sales of Demag products or services.

We also use your personal information to improve our products and services and our customers’ use of our Site. For example, we personalize your shopping and quoting experience by recalling information about you and your previous use of the Site to save you time and provide additional information that might be of interest to you.

Additionally, we may use your personal information to contact you from time to time to inform you of new products or services, changes to the Site, or other online services or special offers we think you might find of value, or as part of our general servicing of customer accounts.

We also analyze the aggregate information we gather about traffic patterns and usage of the Site to help us improve it and its design and layout.

How do we share customers’ personal information with third parties?

In order to process your orders and requests, we make your name, address, and sometimes your e-mail address or telephone number available to other entities such as credit card companies, companies that collect and process credit card information, and package delivery services. If you ask us to ship a particular product to another company, we also tell that entity we are shipping the product at your request.

Additionally, we share information concerning our customers’ purchasing activities through our Site with our partners, dealers, and distributors to explain the amount of their commissions on their sales of Demag products and services. We also share information concerning requests for quotations and the identity of possible future customers with these entities as part of our effort to increase sales.

We may use third party agents, consultants and contractors to perform business functions on our behalf, including customer research, marketing, provision of IT services, and records maintenance. If we give these entities access to our customers’ personal information to perform these functions for us, we do not authorize them to use that information for any other purpose.

It is possible that Demag or part of its business or one of its affiliates could merge with, acquire or be acquired by another business entity and your personal information could be among the assets transferred. If this occurs, you will be notified of the change by e-mail or notice on this Site.

We reserve the right to share personal information about you with our affiliates in the course of our business operations. We also reserve the right to share personal information about you as required by law or in cooperation with legal authorities and to enforce the Terms of Use governing use of this Site or to protect the rights, property, or safety of Demag and its customers.

We may share non-personal non-individually identifiable aggregate information about our customers and their sales and traffic patterns with the group of people with whom we share personal information, as well as with other third parties such as marketing firms.

How can visitors to the Site check or change the information we collect about them?

You can review your personal profile at Demag and correct or update it on sites that require online registration for use, such as our Automated Quotation System, AQS.Demag-us.com. You can also change personal information such as your e-mail address or shipping address.

You cannot access or change the non-personal information.
